This Release and Waiver of Liability (the “Release”) executed on date signed below by “The Volunteer” releases the American Autism Association, their subsidiary and affiliated companies, and all of their respective directors, shareholders, officers, employees, agents, applicable venue owners, sponsors, successors and assigns; Ballet for All Kids and their officers, agents, employees, and trustees; and Ball New York and their officers, agents, employees, and affiliated companies. The Volunteer desires to provide volunteer services for the American Autism Association and engage in activities related to serving as a volunteer at (name of event/program) Ballet for All Kids (“Event or Program”). Volunteer understands that the scope of their relationship with the American Autism Association is limited to a volunteer position and that no compensation is expected in return for services; that the American Autism Association will not provide any benefits traditionally associated with employment to Volunteer; and that the Volunteer is responsible for his/her own insurance coverage in the event of personal injury or illness as a result of Volunteer’s services to the American Autism Association. 1. Waiver and Release: To the fullest extent permitted by law, I, the Volunteer, hereby forever waive, release, indemnify, discharge and hold harmless the American Autism Association and Released Parties from any and all liability, claims, and demands of whatever kind of nature, either in law or in equity, which arise or may hereafter arise from services I provide to the American Autism Association, even if such liability results from the negligent acts or omissions of the Released Parties. I understand and acknowledge that this Release discharges the American Autism Association from any liability or claim that I may have against them with respect to bodily injury, personal injury, illness, death, or property damage that may result from the services I provide to the American Autism Association or occurring while I am providing volunteer services. 2. Insurance: Furthermore I understand that the American Autism Association does not assume any responsibility for or obligation to provide me with financial or other assistance, including but not limited to medical, health or disability benefits or insurance of any nature in the event of injury, illness, death or damage to my property. I expressly waive any such claim for compensation or liability on the part of the American Autism Association beyond what may be offered freely by the American Autism Association in the event of such injury or medical expenses incurred by me. 3. Medical Treatment: I hereby release and forever discharge the American Autism Association and Released Parties from any claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with an emergency during my tenure as a volunteer. 4. Assumption of Risk: I understand that the services I provide to the American Autism Association may include activities that may be hazardous to me including, but not limited to lifting materials or strenuous physical activities. As a Volunteer, I hereby expressly assume the risk of injury or harm from these activities and release the American Autism Association and Released Parties from all liability for injury, illness, death or property damage resulting from the services I provide as a volunteer or occurring while I am providing volunteer services. 5. Assumption of Responsibility: I hereby warrant that I will not cause any risk to any individuals, families, or children partaking in the Event or Program. This risk includes any psychological, physical, or sexual harm imposed on any participants or bystanders. I agree to help facilitate the positive, judgment-free, comfortable, and welcoming environment in which the American Autism Association has created for all event or program participants. 6. Photographic Release: I grant and convey to the American Autism Association all rights, title, and interests in any or all photographs, images, video, or audio recordings of me or my likeness or voice made in connection with my providing volunteer services during an American Autism Association event, workshop, or program. The American Autism Association may use such materials for promotional purposes. 7. Other: I hereby warrant that I have read this Release carefully, understand its terms and conditions, acknowledge and intend for my signature to serve as confirmation of my complete and unconditional acceptance of the terms and conditions of this Release and Waiver. This Release and Waiver represents the complete understanding between the parties regarding these issues and no oral representations, statement or inducements have been made apart from this Release. If any portion of this Release is held to be unenforceable, invalid or overly broad, the remaining terms and provisions of this Release will continue in full legal force and effect. 8. I warrant that I am of legal age, at least 18, and that I have every right to contract in my own name and/or on behalf of a minor. By signing below, I express my understanding and intent to enter into this Release and Waiver of Liability, on behalf of the Minor, willingly and voluntarily and I agree to be legally bound by it. *
